What is a Boundary Adjustment?
Technically a Subdivision, a Boundary Adjustment is completed to change the boundary between two parcels of land.
This can be completed for many reasons, some including:
To transfer arable farmland between neighbours
Fixing an issue where a fence, building, driveway etc doesn’t fit with the boundaries as intended
Increasing the size of land to unlock development potential
To provide direct access to part of a block
Making a fairer distribution of large land holdings for succession planning.

Do I need Council Approval?
In many cases you will need Development Consent from Council, but not always.
If your lots will change by more than a minor amount or 10% depending on if it is urban or rural you may require Development Consent from Council.
However, some great news is that sometimes you might not have to involve Council at all! If your boundary adjustment is to rectify an encroachment, is by less than a minor change in area for rural land or 10% for Urban land then your Boundary Adjustment might be Exempt Development. Yes, the Subdivision Plan that we prepare to complete the Boundary Adjustment will create new lots.

Most land will have a Minimum Lot Size published by Council in their Local Environmental Plan. Depending on the circumstances, we can sometimes still complete the process if your land is under the minimum Lot Size, but it depends on the Local Government Area and other factors.

If the land changing between lots is also changing ownership, then a Solicitor or Conveyancer will be required to lodge a transfer to NSW Land Registry Services. We work with a great Solicitor who we would be happy to recommend for this.
